These Conditions of Use govern your access to and use of BuyerBaba, an online marketplace operated by Maroof LLC. Please read them carefully — by using BuyerBaba or creating an account, you agree to these terms and to our Privacy Notice.
1.BuyerBaba is an online marketplace operated by Maroof LLC (“Maroof LLC”, “we”, “us”, or “our”). These Conditions of Use, together with our Privacy Notice and the policies referenced in them, form a binding agreement between you and Maroof LLC governing your access to and use of the BuyerBaba websites, applications, and services (together, the “Service”). By accessing the Service, creating an account, or placing an order, you agree to these terms. If you do not agree, do not use the Service.
2.You must be at least 18 years old and able to form a legally binding contract to use BuyerBaba. If you use the Service for a business, you confirm you are authorized to act for that business and to bind it to these terms. You must not be barred from using the Service under applicable law, and the information you provide must be accurate and kept up to date.
3.You are responsible for the activity that happens under your account and for keeping your sign-in credentials confidential. Notify us promptly of any unauthorized use or security concern. We may require identity or business verification, and we may refuse, suspend, or close accounts to protect the Service, our users, or to comply with law. Do not share accounts or create an account for anyone else without authorization.
4.BuyerBaba is a venue that connects independent sellers with buyers and provides the tools to transact. Except for any items BuyerBaba sells directly and identifies as sold by us, the seller — not Maroof LLC — is the seller of record: the contract of sale for a listed item is between you and that seller, and the seller is responsible for its listings, pricing, stock, descriptions, and fulfilment. We do not manufacture, inspect, or take possession of seller items and do not warrant them. Where required by law, BuyerBaba acts as a marketplace facilitator and may calculate, collect, and remit applicable sales tax on a transaction.
5.When you place an order, you are making an offer to buy the item on the terms shown at checkout. A contract is formed only when the seller (or BuyerBaba on the seller’s behalf) confirms or dispatches the order. We may limit quantities, and we or the seller may decline or cancel an order — for example where an item is out of stock, a listing or price is materially wrong, payment cannot be verified, or we suspect fraud or a policy breach. If we cancel a paid order, you are refunded to your original payment method.
6.Prices, offers, and availability may change at any time before you place an order. The price, applicable taxes, and shipping shown at checkout apply to that order. Despite our efforts, an item may occasionally be listed with an incorrect price or description; where that happens, neither BuyerBaba nor the seller is obliged to honour the error, and the order may be cancelled and refunded.
7.Payments are processed by our third-party payment provider, Stripe. By submitting a payment you authorize the charge and confirm you are permitted to use the payment method. Card and bank details are handled by the payment provider under its own security standards; we do not store full payment credentials. Platform and seller fees, currency conversion, and applicable taxes are disclosed before they apply. You are responsible for any charges your bank or card issuer adds.
8.Sellers are responsible for fulfilling their orders within the handling and delivery times shown at checkout. Shipping options, costs, and estimated delivery are presented per order and are governed by our Shipping & Returns policy, which forms part of these terms. Risk of loss and title pass to you on delivery unless the applicable policy or law provides otherwise.
9.Returns, refunds, and order cancellations are governed by our Shipping & Returns policy, which is incorporated into these terms. In general, eligible items may be returned within the stated return window, refunds are issued to the original payment method once a return is received and reviewed, and cancellations depend on whether the order has shipped. Nothing in these terms limits any non-waivable consumer rights you have under applicable law.
10.If you register as a seller, your use of BuyerBaba is also governed by the Seller Agreement, which you accept during seller onboarding and which applies in addition to these terms. Sellers are responsible for their listings, fulfilment, customer service, and compliance with our policies and applicable law.
11.You keep the rights to content you submit — such as reviews, questions, images, and listing information — and you are responsible for it. You grant BuyerBaba a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, adapt for display, and use that content to operate, improve, and promote the Service. You confirm you have the rights to grant this licence and that your content does not infringe others’ rights or break the law.
12.Use the Service lawfully and fairly. You must not: break any law or infringe anyone’s rights; commit fraud or manipulate prices, reviews, rankings, or search results; scrape, crawl, or harvest data except as we expressly permit; upload malware or interfere with the Service’s operation or security; attempt to access accounts, data, or systems that are not yours; impersonate others; or arrange transactions off-platform to avoid fees or protections. We may investigate, remove content, and suspend accounts that break these rules.
13.Items sold through BuyerBaba must be lawful, safe, accurately described, and permitted under our policies. Illegal, stolen, counterfeit, recalled, hazardous, or otherwise restricted items are prohibited, and some categories are allowed only subject to conditions and applicable law. We may remove any listing, and withhold or reverse related payouts, that we reasonably believe breaches this section.
14.The BuyerBaba name, logo, software, design, text, and graphics (other than user or seller content) are owned by Maroof LLC or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service or its content except as the law allows or we permit in writing.
15.We respond to clear notices of alleged copyright or trademark infringement and, in appropriate cases, remove content and terminate repeat infringers. Infringement notices can be submitted through our Help Center. Please only report material you genuinely believe is infringing; notices made in bad faith may carry liability under applicable law.
16.The Service relies on and links to third parties — for example the payment provider and shipping carriers. Their services are governed by their own terms and privacy practices, and BuyerBaba is not responsible for third-party websites, content, or services. Your dealings with a third party are between you and that party.
17.The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Maroof LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, in relation to the platform. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that listings, content, or availability will always be accurate. Items are the responsibility of the seller offering them; any warranty on an item is provided by that seller or the manufacturer, not by BuyerBaba, unless we state otherwise.
18.To the fullest extent permitted by law, Maroof LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service or a transaction is limited to the greater of the amounts you paid to Maroof LLC for the transaction giving rise to the claim in the 12 months before it arose, or US$100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you, and nothing here limits liability that cannot be limited by law.
19.You agree to defend, indemnify, and hold harmless Maroof LLC and its officers, employees, and agents from claims, losses, and reasonable costs (including legal fees) arising from your use of the Service, your content, your breach of these terms or of applicable law, or — if you are a seller — your listings, products, or fulfilment.
20.You may stop using BuyerBaba at any time. We may suspend or terminate your access, in whole or in part, for breach of these terms, risk or legal reasons, or extended inactivity, with notice where practicable. Obligations that by their nature should survive — including payment obligations, content licences, intellectual-property terms, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.
21.We may update these terms as BuyerBaba evolves. If we make material changes, we will post the updated terms with a new effective date and, where appropriate, give additional notice. Changes are not retroactive. By continuing to use the Service after an update takes effect, you accept the revised terms.
22.These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules. Before starting formal proceedings, you agree to first try to resolve any dispute informally by contacting us through the Help Center, and to allow 30 days to resolve it. Subject to any non-waivable rights and to mandatory consumer-protection rules that apply where you live, you agree that the state and federal courts located in the Commonwealth of Virginia, United States have exclusive jurisdiction over disputes that are not resolved informally.
23.These terms, with the Privacy Notice and the policies they reference, are the entire agreement between you and Maroof LLC about the Service and replace any prior understanding. If any provision is held unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them to an affiliate or successor. Neither party is liable for delays caused by events beyond its reasonable control. You agree we may provide notices and agreements electronically.
